PRIVACY POLICY
This PRIVACY POLICY details the use and disclosure of personally identifiable information collected from Users. We provide this PRIVACY POLICY to help you make an informed decision about whether to use Lexxica’s Services. Your continued use of any Lexxica website constitutes your acceptance and agreement to be subject to the terms of this PRIVACY POLICY and Lexxica’s TERMS OF USE.
Lexxica recognizes that our customers value their privacy. Our policy is that any personally identifiable information that you disclose to Lexxica when using any of Lexxica’s Services, including in particular your email address, real name, as well as any other personal information we receive, shall be kept confidential and used only to provide you with Lexxica’s Services.
Your Responsibilities
To protect your privacy and security, you are responsible for the creation of a unique Login ID and secret Password which will be used to verify your identity each time you access your account. Users agree that they are solely responsible for the creation and maintenance of their unique Login ID and secret Password. Be advised that once a Login ID is created it cannot be changed. Please keep a hardcopy record of your Login ID somewhere safe and outside of your device. Your secret Password may be changed at any time by visiting the Settings page in your account.
You may decline to submit personally identifiable information such as your real name and email address however if you do that Lexxica will not be able to provide all available Services to you.
You may update your personal information such as your real name, email address at any time by visiting the Settings page of your account. You may quit and delete your account including all personally identifiable information at any time by visiting the Settings page of your account.
Our Commitment to Data Security
Lexxica uses industry standard physical, managerial, and technical safeguards to preserve the integrity and security of the personal information that you disclose to us such as your name and email address. Lexxica shall not willingly disclose your personal information to any third parties without your permission except as required by Japanese law. However, Lexxica neither ensures nor warrants the security of any information you transmit to Lexxica via the Internet and Lexxica cannot guarantee that such information may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards.
If Lexxica learns of a security systems breach Lexxica may post a notice on social media and the WordEngine and V-Admin websites and we may attempt to notify you by email so that you can take appropriate protective steps. In order to protect Users’ privacy and to provide increased processing and storage capacity to active accounts the Company deletes all inactive premium accounts 400 days after the last date of study and deletes free trial accounts 90 days after the free trial period ends.
Data Transferred to a V-Admin Group
When you join a V-Admin group or any other WordEngine group service, you authorize Lexxica to provide that group’s manager with your real name, test scores, and learning progress data. We will not disclose your email address to any V-Admin group managers who are not directly employed by Lexxica. By using a Lexxica website you indicate your understanding and agreement that Lexxica can neither control nor be held responsible for the ways that an independent V-Admin group manager might use your real name, test scores, and learning progress data.
About Children’s Privacy
Any portions of our website that are directed to persons under 13 may only be accessed upon receipt of legal consent from the child’s parent or legal guardian. If you are under 13 years of age, you must have your parent or legal guardian complete the User account registration process in order for you to use a Lexxica website. If Lexxica learns that personally identifiable information of persons under 13 years of age has been collected on the Lexxica websites without parental consent, then Lexxica will take appropriate steps to delete such information.
Note to International Users
As of the date indicated below, the Lexxica websites are hosted in Japan, a country that maintains relatively strict consumer privacy protection laws. If you access the Lexxica websites from the European Union, the United States, China, Korea, or any other country, please be advised that your use of the Lexxica websites indicates your specific consent to the transfer of your personal information to Lexxica servers located in Japan and operating under the governance of Japanese law.
How Lexxica Collects Information
User Provided Information: When responding to questions on the Lexxica websites, or when participating in any groups, forums, contests, surveys, or newsletters, you may be asked to provide certain personally identifiable information such as your real name, your organization name, and your active email address.
Cookies Information: When you visit a Word Engine website operated by Lexxica, we send one or more cookies – a small text file containing a string of alphanumeric characters – to your computer to identify your browser. Lexxica uses both session cookies and persistent cookies. A session cookie is temporary and disappears after you close your browser. A persistent cookie remains after you close your browser. Persistent cookies may be used by your browser on subsequent visits to the Lexxica websites. Cookies can be removed by following the clear cache instructions in the settings for your web browser. If your browser is set to refuse Lexxica’s cookies, the Services will not function properly.
Log File Information: When you use the Lexxica websites, our servers automatically record certain information that your web browser sends whenever you visit any website. These server logs include information such as your web request, Internet Protocol (“IP”) address, browser type, browser language, referring / exit pages and URLs, platform type, number of clicks, domain names, landing pages, pages viewed and the order of those pages, the amount of time spent on particular pages, the date and time of your request, and one or more cookies that may uniquely identify your browser.
Clear GIFs Information: When you use the Lexxica websites, we may employ “clear GIFs” (a.k.a. Web Beacons) which are used to track the online usage patterns of our Users anonymously (i.e., in a non-personally-identifiable manner). In addition, we may also use clear GIFs in the HTML-based emails sent to our users that will track which emails are opened by recipients.
How Lexxica Uses Information
If you submit personally identifiable information to us through any Lexxica website we will use your personal information to operate, maintain, and provide you with the features and functions of the WordEngine and V-Admin Services. Any personally identifiable information that you disclose to Lexxica through the Services shall be kept confidential and used only to provide the Lexxica Services to you. If you create a Display Name for your User account it will become visible to other Users on ranking and contest result pages. Any data that you submit to any public spaces on a Lexxica website or any social media pages operated by the Company can be viewed by the general public.
If we have your email address on file we may use it without advance notice to notify you about maintenance work, and upgrades to the Services. We may also include commercial messages and hyperlinks in the emails that we send to you. Users shall have the ability to opt-out of email support services on the settings page of their account, and also in the footer section of each email.
To improve the quality of the Lexxica websites and to create new features and functionality we analyze Users’ non-personally-identifiable response data and other interactions data. We also greatly value all of the User comments and suggestions that we receive.
Please note that all anonymous response and interactions data as well as any content you voluntarily post to publicly accessible spaces within the Services becomes Published Content and is not considered personally identifiable information subject to this PRIVACY POLICY.
In some cases Published Content submitted by a User may remain in a publicly accessible space within the Services and in all such cases that content is subject to our TERMS OF USE regarding Published Content.
When Lexxica Discloses Information
We do not share personally identifiable information such as your actual name, organization name, and email address with any third parties. We provide access to your personally identifiable information only to our employees and contracted partners, and only for the express purpose of fulfilling and enhancing the Services that Lexxica offers. We require that our staff and our contracted partners agree to handle and process your personal information in full compliance with our PRIVACY POLICY. We take all reasonable precautions to protect and limit the use of your personally identifiable information by executing and maintaining confidentiality agreements and by implementing industry best practices for data security.
We release personally identifiable information only to comply with the laws of Japan, or international laws (such as international Copyright Law) or respond to a Japanese court order, subpoena, or search warrant.
Lexxica reserves the right to disclose personally identifiable information if we believe, in good faith, that doing so is necessary to enforce our TERMS OF USE, or take precautions against liability, or defend ourselves against defamatory allegations, or protect the security and integrity of our website, or protect the rights, property, and safety of our Users.
Third Party Advertisers and Links to Other Sites
Lexxica may invite other companies called third parties to provide content and or advertisements within the Lexxica websites. These third parties may use technology to send links and advertisements that may appear on Lexxica’s websites. Third parties may use technologies such as cookies, JavaScript, or Web Beacons to measure the effectiveness of their advertisements and to enhance their content.
Lexxica shall not provide any personally identifiable information about you to any third parties without your consent. Lexxica displays third party information which we consider useful and advantageous to our Users. Lexxica’s TERMS OF USE and PRIVACY POLICY do not apply to the activities of the websites of third parties. You are advised to consult the respective terms of use and privacy policies of any third party websites that you choose to visit. If you believe that any of the third parties linked to our Services are involved in any form of abusive activities please contact Lexxica with details of the problem so that we may take appropriate steps to improve our Services.
In the Event of Merger, Sale, or Bankruptcy
In the event that Lexxica is acquired by, or merged with a third party entity, we reserve the right in any of these circumstances to transfer or assign the information we have collected from our Users as part of such merger, acquisition, sale, or other change of control. In the unlikely event of our bankruptcy, insolvency, reorganization, receivership, or assignment for the benefit of creditors, or the application of laws or equitable principles affecting creditors’ rights generally, we may not be able to control how your personal information is treated, transferred, or used.
TERMS OF USE
The Lexxica Corporation, hereinafter referred to as the “Company”, makes available various WordEngine services and products including the V-Check lexical assessments, learning tools, V-Admin management services, and other interactive web-based services. For the purposes of this TERMS OF USE agreement and PRIVACY POLICY the Company’s services and products, whether individually or collectively, shall be referred to as the “Services”, and each person that makes use of Lexxica’s Services shall be referred to as a “User”.
The Company shall not publish nor disclose to third parties a User’s real name, email address, organization name, or any other personally identifiable information unless the User has specifically permitted such disclosure. All personally identifiable information submitted by the User will be used solely for the purpose of operating and improving the Services for the benefit of Users.
The User accepts that all anonymous responses and interactions made by the User through any aspect of the Services shall not be considered personally identifiable data. The User accepts that anonymous responses and interactions by the User shall become the intellectual property of the Company.
The User accepts that all anonymous responses and interactions made by the User through any aspect of the Services shall be analyzed by the Company and that such analysis may result in the publication and dissemination of research and findings based on such data. Such analysis may look at aspects of lexical ability by age, gender, native language, educational experience, and culture.
User agrees that under no circumstance shall User publish false assertions or make abusive and or derogatory claims about the Company on social media. User agrees they shall not send abusive email or text messages to the Company for any reason whatsoever. User agrees they shall not create profane, foul or abusive nicknames in any part of their user account. User accepts that the Company has the exclusive right to determine what constitutes abusive, derogatory, foul or abusive statements and nicknames. User accepts that the Company has the exclusive right to suspend or terminate a User’s account without any form of compensation if Company determines the User has published abusive, derogatory, foul or abusive statements and nicknames.
The Company may, from time to time, request to publish a User’s comments and or endorsement of the Services. Any such request might also include a request for permission to disclose the User’s name and or organizational affiliation. Users are under no obligation whatsoever to grant any such approval to the Company.
The Company’s Services have been designed to operate with the latest HTML web browsers and mobile devices, however the Company can offer no assurance that the Services will operate as described on each User’s system. The User hereby accepts this fact and understands that newer hardware, operating systems, browsers, plug-ins, and or other elements may be required of the User in order to gain access to and utilize all features of the Services. Any User that encounters a problem accessing the Services should report the nature of the problem to the Company so that we may consider appropriate remedial action.
The User agrees that all information and content published by the Services has been prepared with the utmost care using the Company’s proprietary systems and algorithms. The User assumes full responsibility for all risks that may exist through use of the Services. The User accepts that the Company may need to change aspects of the Services from time to time and that any such changes may occur without prior notice to the User and may inadvertently result in the deletion or loss of existing User data.
The User agrees that in order to provide greater personal data security, and to provide increased processing and storage capacity for active learners, the Company shall delete WordEngine accounts within 400 days after the date of last login. Additionally, the Company shall delete all unused free trial accounts 90 days after a free trial period ends.
Users who purchase a premium plan by making monthly payments agree that the User has sole responsibility to terminate their monthly payment plan when they choose to stop using WordEngine, and the date for any such cancellation and final payment shall be determined solely by the User’s credit provider, not by the Company.
The User accepts that the Services may experience occasional interruptions due to scheduled and unscheduled server maintenance procedures, and that the Company shall endeavor to provide advance notice of Services disruptions to Users via messages, social media, and email notifications whenever possible.
The User accepts that in providing the Services via the Internet, data exchanges are exposed to various security risks. The Company shall make efforts consistent with industry standards to protect the security and privacy of User account records and, in particular, to protect real names, email addresses and organization names against misappropriation and misuse. The User hereby agrees to hold the Company harmless from any and all claims of material damage related to the integrity and security of the Services and web sites. The User agrees that under no circumstance shall the User publish derogatory claims, or make direct or indirect derogatory claims against the Company based on any perceived form of damage alleged to have been caused by representations, or lack of representations, by the Company about the Services.
The Company maintains that all copyrights, trade names, registered trademarks, patents, and content including but not limited to: text, documents, graphic images, audio recordings, video programs, etc. that are published or displayed through the Services are protected intellectual property presented under the auspices of the Company and are subject to all relevant legal protections under international Copyright, Trademark, and Patent Laws, and the laws of Japan.
Any User that desires to reproduce or reuse the intellectual property of the Company must first seek prior written approval of the Company or risk prosecution under applicable laws. The proprietary systems and methods utilized in the Services have been submitted for trademark and patent protection in all countries that are members to the international patent cooperation treaty. The User hereby acknowledges and agrees to respect the copyrights, trade names, registered trademarks, patents, and proprietary systems and methods of the Services as the exclusive and proprietary property of the Company.
The User accepts that the Company may, from time to time, post and display hyperlinks on its websites and email and that such hyperlinks may lead to web sites and or applications that are neither owned nor controlled by the Company, and furthermore the User accepts that the Company shall bear no responsibility for any content or quality issues or problems encountered by the User when accessing or using any such external hyperlinks.
The User accepts that the Company may display both non-commercial hyperlinks and commercial hyperlinks in the Services. The User agrees that any transactions or business that may be conducted between the User and the owner of an external website that was accessed through the Company or any of its web sites or emails shall be entirely outside the scope of this Terms of Use agreement and therefore the Company shall bear no responsibility or liability whatsoever for any such interactions.
By checking the “I AGREE” box and creating a registered User account, you signify your acceptance and agreement to all of the terms and conditions of this TERMS OF USE agreement, and to all of the terms and conditions of the PRIVACY POLICY, which is incorporated as an integral part of this TERMS OF USE agreement. This TERMS OF USE agreement applies to all Users of the Services. Please note the effective date of this TERMS OF USE agreement and PRIVACY POLICY. The Company reserves the exclusive right to modify this TERMS OF USE agreement and the PRIVACY POLICY from time to time. You are requested to revisit these pages periodically in order to remain aware of any such revisions. Continued use of the Services constitutes your agreement to the most recent posted TERMS OF USE agreement and PRIVACY POLICY. Should a future revision to the TERMS OF USE or PRIVACY POLICY result in terms and conditions that are materially less restrictive with regard to the disclosure of your personally identifiable information as provided for by this TERMS OF USE agreement and this PRIVACY POLICY, the Company will first seek to obtain your consent by contacting you by direct message sent to the inbox inside your account before implementing any such material changes. You shall be given the right to cancel the Services or refuse to accept any such materials revisions and such revisions shall not be applied to any of your previously collected personally identifiable information. If you do not agree to any of these terms and conditions then you should stop using the Services.
